PLEASE READ THIS END USER LICENSE AGREEMENT CAREFULLY. This end user license agreement (“EULA”) is a legal agreement between you (“End-User”) and Gamesoft Interactive Limited (“the Developer”). Please read this EULA carefully before downloading, installing, copying, or otherwise using the videogame, application, their associated upgrades, patches, updates and related services (“the Game”). Gamesoft’s Privacy Policy which can be found on https://www.gamesoft.com/privacy/, forms an integral part of this EULA.
By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this EULA and the terms of the Privacy Policy. If you do not agree with the terms of either this EULA or the Privacy Policy, please do not install, copy, or use the Game.

1. License Grant

Subject to your compliance with the terms of this EULA, the Developer (“Licensor”) grants you a limited, non-exclusive, non-transferable, revocable license to install, access, and use the Game for your personal, non-commercial entertainment purposes. This license is granted solely for use in accordance with the terms and conditions of this EULA.

2. Intellectual property

All title, ownership rights, and intellectual property rights in and to the Game, including without limitation any content or software, are owned by the Developer or its licensors. The Game is protected by copyright laws, intellectual property laws and treaties as well as international copyright treaties. The EULA does not grant you any rights to patents, copyrights, trade secrets, trademarks, or any other intellectual property rights in connection with the Game.

3. Prohibitions

You shall not, directly or indirectly: a) Copy, modify, adapt, translate, or create derivative works based on the Game; b) Sell, rent, lease, sublicense, distribute, or otherwise transfer rights to the Game to any third party; c) Remove, alter, or obscure any copyright, trademark, or other proprietary notices on or in the Game; d) Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the Game; e) Use the Game in any manner that violates any applicable law or regulation or in any way that may harm or damage the Developer’s reputation; f) Use any unauthorized third-party software or service to gain an unfair advantage in the Game.

4. User Content

You may have the ability to create or submit content within the Game (“User Content”). By creating or submitting User Content, you grant the Developer a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, and sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in any media now known or hereafter devised, without any compensation to you.

5. Limitation of Liability

IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE GAME OR THIS EULA, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. Termination

The Developer may terminate this EULA at any time if you fail to comply with the terms and conditions set forth herein. Upon termination, you must immediately cease all use of the Game and destroy all copies of the Game in your possession or control.

7. Limited Warranty and Disclaimer of Warranties

a) The Developer warrants that it has the right to grant the license to use the Game as set forth in this EULA.

b) The Game is provided on an “as is” basis without any warranties of any kind, express or implied. To the maximum extent permitted by applicable law, the Developer disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights. The Developer does not warrant that the Game will meet your requirements or that the operation of the Game will be uninterrupted or error-free.

c) You acknowledge and agree that the use of the Game is at your own risk. The Developer shall not be be responsible for any damages, loss of data, or other harm resulting from your use of the Game or any content or software related thereto.

d) The Developer does not guarantee that the Game will be compatible with all devices, hardware, or operating systems. You are solely responsible for ensuring the compatibility of your devices with the Game.

e) The Developer does not warrant or guarantee the accuracy, reliability, or completeness of any information provided within the Game. Any reliance on such information is at your own risk.

f) You acknowledge that the Game may contain links to third-party websites or services. The Developer does not endorse or control these third-party websites or services and shall not be responsible for their content or any damages or losses incurred as a result of your use of such websites or services.

8. Governing Law

This EULA shall be governed in all respects by the Laws of England and Wales, and shall be construed accordingly, and shall inure to the benefit of the Licensor and the End-User and their successors, assigns and legal representatives. If any provision of this License is held by a court of competent jurisdiction to be invalid or unenforceable to any extent under applicable law, that provision will be enforced to the maximum legally permissible extent, while all other provisions of this EULA will remain in full force and effect.

9. Entire Agreement

This EULA constitutes the entire agreement between you and the Developer regarding the Game and supersedes all prior or contemporaneous agreements, understandings, or representations.
By installing, copying, or using the Game, you acknowledge that you have read and understood this EULA and agree to be bound by its terms and conditions.
